Our Probate fee includes the following:

1.     Our first consultation.

2.     Initial advice on the Probate process, executor and trustees role and and estate administration process.

3.     Publishing a Notice of Intent to apply for probate.

4.     Drafting a summons for probate.

5.     Drafting the affidavit of the executor.

6.     Drafting the grant of probate.

7.     Filing the summons for probate and supporting affidavits.

8.     Responding to requisitions/queries by the Court.

9.     Furnishing you with a sealed copy of the Probate.

Our Probate fees do not include the following items:

1.     Supreme Court of NSW Probate filing fee.

2.    Supreme Court of NSW Notice filing fee.

3.     Disbursements.

4.     Fees for assisting executors and trustees complete the administration process of the Estate.

Additional Administration Costs

For tasks such as assisting with the sale of assets, distributing assets to beneficiaries, paying liabilities, and liaising with accountants or other relevant parties, these costs will be discussed and confirmed during our initial consultation. Typically, additional administration costs are fixed between $1,500.00 and $6,000.00, though they may be higher depending on the complexity of the matter.

Please note, if the situation becomes more complex than initially expected—such as additional disbursements, family provision claims, contested wills or probate, or any other reasonable circumstances requiring further work—we will notify you and provide an amended cost agreement. We are diligent with our pricing and strive to ensure that any costs quoted are sufficient to see your matter through to completion.

Our standard hourly rate outside of fixed fees is $350, including GST, charged in six-minute increments.

Cost Agreement and Disclosure     

Upon engaging us for our services, we will promptly issue a Cost Agreement and Disclosure which will set out the terms of our offer to provide legal services to you and will constitutes our costs agreement and disclosure pursuant to the Legal Profession Uniform Law (NSW) (“the Uniform Law”). The cost agreement and disclosure will constitute the entirety of the agreement between you and us.
