What is a Simple Will?

A simple will is straightforward and suitable for most individuals. It outlines who your executor(s) and trustee(s) will be, how your estate will be distributed after your passing, who your beneficiaries are, and any specific wishes regarding burial, cremation, or funeral services.

Our principal has previously drafted wills with unique requests, including having ashes scattered in outer space, in specific parts of the world, and burial arrangements according to religious customs. Please note that a simple will does not include provisions for testamentary trusts, complex beneficiary arrangements, business succession instructions, or specific directions for the care of children with disabilities. If your circumstances require these or other complexities, we can certainly draft a will to accommodate them. However, it’s best that we meet first to determine whether a simple will is appropriate for your needs.

Understanding the Difference Between a General and Enduring Power of Attorney

A General Power of Attorney grants someone authority to manage your financial and legal affairs while you still have decision-making capacity. It ceases to have effect if you lose capacity, making it suitable for temporary situations like travel or illness.

An Enduring Power of Attorney, on the other hand, remains valid even if you lose the capacity to make decisions. This makes it ideal for long-term planning and ensuring your affairs are managed if you become incapacitated.

When to Choose and Register a Power of Attorney

  • Choose a General Power of Attorney if you need someone to act on your behalf temporarily, such as during a holiday or medical recovery.

  • Choose an Enduring Power of Attorney if you want to prepare for the possibility of losing decision-making capacity in the future.

In New South Wales, registering an Enduring Power of Attorney is not always mandatory but is recommended if the attorney will handle property transactions. Registration is done through NSW Land Registry Services and costs $171.70 (as of 2024 - on 1 July every year this amount increase).

What is an Enduring Guardianship?

When to Appoint an Enduring Guardian

You should consider appointing an Enduring Guardian if:

  • You want to ensure that your preferences for personal and medical care are upheld in case you become unable to make decisions.

  • You have specific wishes about your care that you want a trusted individual to follow.

Unlike a Power of Attorney, an Enduring Guardianship is focused on personal and medical decisions rather than financial or legal matters.

Is Registration Required?

In New South Wales, an Enduring Guardianship does not need to be registered. However, the appointment must be formally witnessed and signed by an eligible witness, such as a solicitor, barrister, or registrar of the Local Court.
